U.S. to Impose 25% Section 232 Tariffs on Beer and Empty Aluminum Cans Starting April 4, 2025

Washington, D.C. – April 2, 2025 – The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) has announced the addition of two aluminum derivative products to the list of items subject to the 25 percent Section 232 aluminum tariffs. The new tariffs will apply to malt beer and empty aluminum cans, effective April 4, 2025, at 12:01 a.m. Eastern Time.

The draft Federal Register Notice specifies that malt beer, classified under tariff code 2203.00.00 of the Harmonized Tariff Schedule of the United States (HTSUS), and empty aluminum cans, classified under HTSUS subheading 7612.90.10, will be subject to the previously announced tariffs.

Notably, the notice does not currently include any exemptions for products qualifying under the United States-Mexico-Canada Agreement (USMCA). U.S. Customs and Border Protection (CBP) is expected to release further guidance on how the duties will be applied. Specifically, it is anticipated that the 25 percent tariff will be imposed on the value of the aluminum content in imported malt beer. In cases where the value of the aluminum content cannot be determined or proven, the entire value of the imported beer will be subject to the tariff.

In addition, the 25 percent duties will also apply to the aluminum content in empty aluminum cans.

This move is the latest in a series of tariff actions aimed at addressing concerns over aluminum imports and their impact on U.S. producers.
