New California Law Mandates Drug Testing Kits in Bars and Nightclubs

Starting July 1, 2023, a new law in California will require bars and nightclubs with a Type 48 license to offer drug testing kits to customers. These kits, which can include test strips, stickers, or straws, are designed to detect the presence of “roofies” (Rohypnol) and other date rape drugs in drinks.

Establishments will be responsible for providing these kits either free of charge or for a reasonable fee. They will also be required to display signs with the message: “Don’t get roofied! Drink spiking drug test kits available here. Ask a staff member for details.”

The California Department of Alcoholic Beverage Control (ABC) estimates that approximately 2,400 establishments will be impacted by this new law. Failure to comply could result in penalties for the license holder.
